RELEASE, ASSUMPTION OF RISK AND INDEMNIFICATION AGREEMENT

CAUTION — This is a Release of legal rights. Read and understand before signing.

I am either participating or am the parent/guardian of a minor participating in tennis and fitness activities at Bloomington Tennis & Turf, 4101 Wicker Drive, Bloomington, McLean County, Illinois (“the Property”). Participation in these activities is voluntary. As a condition of participation and in consideration of being allowed to participate, I agree as follows:

Release and Discharge

• If I am of legal age (18 years or older), I, individually, and on behalf of my heirs, successors, assigns, and personal representatives, release, acquit, and forever discharge Bloomington Tennis & Turf and its principals, heirs, assigns, successors, employees, agents, and representatives from any liability for damages, losses, or injuries to my person or property.
• If I am the parent or guardian of a minor under eighteen (18) years of age participating in these activities, I, individually and on behalf of the minor child and his/her heirs, successors, assigns, and personal representatives, release, acquit, and forever discharge the same entities from any liability for damages, losses, or injuries to the minor’s person or property.

Assumption of Risk:

• I acknowledge that participating in tennis and fitness activities is potentially dangerous, and I (or the minor child, if applicable) voluntarily assume all risks associated with participation, including but not limited to injury or death.

Scope and Enforceability:

• This agreement is intended to be as broad and inclusive as permitted by the laws of the State of Illinois. Should any portion of this agreement be held invalid, the remainder will continue in full legal force and effect. Legal proceedings related to this agreement will be held in McLean County, Illinois.
  

Acknowledgment of Understanding

• I affirm that if I am signing on my own behalf, I am of legal age, and I am freely signing this agreement. I have read this entire agreement and understand that by signing it, I am giving up substantial legal rights, including the right to sue.

• If I am signing as the parent or guardian of a minor, I consent to the minor’s participation and affirm that I have the legal authority to sign this waiver on their behalf.

Membership Cancellation

• Membership fees at Bloomington Tennis & Turf are paid via recurring monthly charges.  Memberships can be canceled at any time by emailing Kim@blonnotennisturf.com.  If you cancel and want to reinstate your membership within 12 months of the cancellation date, you are subject to a $70 reinstatement fee.
